Terms of Service – GenDesk Ltd

These Terms of Service (“Terms”) govern your access to and use of GenDesk’s website, AI receptionist tools, and related software (the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility & Accounts

You must be at least 18 years old and able to enter binding agreements. You’re responsible for your credentials, compliance with laws, and all activity under your account.

2. Description of Service

GenDesk provides AI-powered tools for handling calls, bookings, and customer inquiries, including integrations. Features may be added, changed, or removed; we’ll try to notify you of major changes.

3. Subscriptions, Billing & Payments

• Some features require a subscription. You authorize charges to your payment method for recurring fees.
• Subscriptions renew automatically unless cancelled.
• Fees are listed in your selected currency and exclude applicable taxes unless noted.
• You’re responsible for any applicable taxes.

4. Cancellations & Refunds

You may cancel at any time. Access continues to the end of the current period. Payments are generally non-refundable; see our Refund Policy for details.

5. Acceptable Use

You agree not to use the Service for illegal or harmful purposes, to harass or mislead, to attempt unauthorized access, to reverse engineer (except where permitted by law), or to disrupt the Service.

6. Service Availability & Modifications

We aim for reliable service but do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or modify/discontinue features with reasonable notice when practical.

7. Intellectual Property

GenDesk and its licensors own all rights to the Service. You receive a limited, non-exclusive, non-transferable license to use it for your internal business purposes under these Terms.

8. Limitation of Liability

To the maximum extent permitted by law, GenDesk is not liable for indirect or consequential damages or loss of profits/data. Our total liability will not exceed the fees you paid in the three (3) months before the event giving rise to the claim.

9. Indemnification

You agree to indemnify GenDesk against claims arising from your use of the Service or violation of these Terms.

10. Changes to These Terms

We may update these Terms; we’ll revise the “Last updated” date and provide additional notice for material changes. Continued use after changes means acceptance.

11. Governing Law

These Terms are governed by the laws of Ontario and applicable federal laws of Canada. Courts in Ontario have exclusive jurisdiction.
